By using the Site you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have the legal capacity to agree to these Terms. If you use the Site on behalf of a business or other entity, you represent that you have authority to bind that entity, and “you” refers to both you and that entity.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

The Site describes the accounting, tax preparation, bookkeeping, and strategic tax planning services offered by Fausak Accounting. Use of the Site — including browsing, reading content, or submitting the contact form — does not create a client, engagement, or fiduciary relationship between you and Fausak Accounting. A client relationship is formed only through a separately signed engagement letter or written services agreement.

Please do not send confidential or sensitive financial information (such as Social Security numbers, account numbers, or tax documents) through the contact form. Established clients should use the secure client portal for document exchange.

Content on the Site is provided for general informational purposes only and does not constitute accounting, tax, legal, investment, or other professional advice. Tax laws change frequently and their application depends on your specific facts and circumstances. You should not act or refrain from acting based on Site content without first obtaining advice from a qualified professional engaged for that purpose. Use of the Site is not a substitute for a professional engagement.

You agree not to, and not to attempt to:

• use the Site in any way that violates applicable law or regulation;
• interfere with or disrupt the Site, its hosting infrastructure, or the contact form (including submitting spam, automated submissions, or malicious code);
• impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• probe, scan, or test the vulnerability of the Site or circumvent any security or rate-limiting measures;
• scrape, harvest, or collect information from the Site by automated means without our prior written consent; or
• frame or mirror any part of the Site without our prior written consent.

The Site and its contents — including text, graphics, logos, images, page design, and underlying code — are owned by or licensed to Fausak Accounting and are protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal or internal business evaluation of our services. No other rights are granted. The Fausak Accounting name and logo may not be used without our prior written permission.

The Site links to third-party services that we do not control, including the TaxDome client portal (used for secure client access) and Web3Forms (used to deliver contact-form messages). Your use of third-party services is governed by those parties’ own terms and privacy policies, and we are not responsible for their content, availability, or practices. A link does not imply our endorsement.

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT CONTENT IS ACCURATE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY LAW, FAUSAK ACCOUNTING AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND IT DOES NOT APPLY TO SERVICES PROVIDED UNDER A SIGNED ENGAGEMENT LETTER, WHICH ARE GOVERNED BY THAT ENGAGEMENT.

You agree to indemnify, defend, and hold harmless Fausak Accounting and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Site.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fausak Accounting regarding use of the Site and supersede any prior understandings on that subject. Our failure to enforce any provision is not a waiver of our right to do so later.
